This Privacy Policy, which is incorporated into our Terms of Service, outlines the privacy practices of QuackQuack Professional Services, Inc. and its affiliates (collectively “QuackQuack,” “Company,” “us,” “we,” or “our”) in connection with your (“you” or “your”) access to or use of our Website https://www.quackquack.com and related services (collectively with the Website, the “Service”). This Policy applies to all our websites, mobile applications, and other online services (collectively, the "Platform"). By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by our terms, including this Privacy Policy. Undefined capitalized terms used herein shall have the definitions as set forth in our Terms of Use. By accessing or using the Platform, you agree to this Policy. KEY TERMS

"Content" means text, graphics, images, music, software, audio, video, information or other materials, including but not limited to profile information, Pro Services requests, quotes, message threads, reviews, scheduling and calendar information, and other information or materials available on or through the Platform.

"Consumer" means a User who is registered to search for Service Professionals on the Platform, seeks Pro Services from Service Professionals on the Platform, makes a booking with a Service Professional to purchase a Pro Service (or receive a quote in contemplation thereof), is registered for or undergoes a home specialist consultation or similar service with respect to their home, utilizes a QuackQuack plan to track maintenance on a home, is a QuackQuack Plus member, or otherwise uses the Platform to receive, pay for, review, or facilitate the receipt of Pro Services. Because a Consumer may be, or may become, a customer of a Service Professional, a Consumer is often referred to as a “customer” or a “Customer” on the Platform and in marketing materials related to the Platform.

"Platform" has the meaning set forth in the opening paragraph above.

"Pro Services" means the services listed, quoted, scheduled, fulfilled or provided by Service Professionals, or sought, scheduled, paid for or received by Consumers, through the Platform.

"Service Professional" means a User who uses, or is registered to use, the Platform to offer, provide, receive payment for, or facilitate the provision of Pro Services. Service Professionals are often referred to as “pros” on the Platform.

"QuackQuack Content" means all Content Quack Quack makes available on or through the Platform, including any Content licensed from a third-party, but excluding User Content.

"User" means a person or entity who uses the Platform, including, for example, a person who completes QuackQuack's account registration process, agrees to the Terms of Use, utilizes any services offered by or through the Platform, or submits or receives a request through QuackQuack, including but not limited to Service Professionals and Consumers.

"User Content" means all Content submitted, posted, uploaded, published, or transmitted on or through the Platform by any User of the Platform, including but not limited to photographs, profile information, descriptions, postings, reviews, requests, messages, and payments made through the Platform, but excluding QuackQuack Content and Feedback.

HOW DO WE COLLECT INFORMATION?

The personal information we collect through our Website, affiliates, or service providers may be acquired through the following means:

• Information you provide when you submit a Request or other webforms on our Website. This encompasses data you furnish when creating an online account, subscribing to our e- newsletters or other communications, seeking information from us, engaging with customer support, reporting issues with our Website or Service, or engaging in other forms of communication with us.
• Records and copies of your correspondence, including email addresses, if you reach out to us.
• Your survey responses, which we or our service providers might request for research purposes.
• Your search queries conducted on our Website.
• Interactions with customer service/support.
• Information from third-party websites and mobile applications (e.g., websites sharing information with us or advertising partners about online activities).
• Data from suppliers (e.g., companies providing consumer demographics and other data).
• Data acquired from mobile applications (parent, subsidiary, and affiliate brands).
• Joint marketing partners.
• Online advertising companies.
• Social media companies.
• Other service providers.

Like many companies, we also collect internet and device information, such as from cookies and other automated technologies, when you browse our website or interact with our advertisements on other sites or social media platforms.

We collect all of this information for our business purposes, namely, to provide and improve our Service. Part of this includes compliance with applicable laws, such as responding to legal requests, enforcing this Privacy Policy and our rights, and protecting others and our Service. We may also use information for short-term, transient use for an interaction with you and to personalize your experience and communications. We use information for security purposes and to protect against harmful activity. Further, we may use information for debugging for functionality, auditing interactions, and internal research. Moreover, we may use information as otherwise instructed by you and with your consent.

In addition, we collect information for commercial purposes, meaning to market our goods and services. For example, we collect device and other data to better target advertisements and other content in an effort to create a more personally relevant experience

HOW WE USE YOUR INFORMATION

We may use your information for any of the following reasons:

• For the purposes for which you provided it;
• To enable you to use the services available through the Platform, including registering you for our services and verifying your identity and authority to use our services;
• For customer support and to respond to your inquiries;
• For internal record-keeping purposes;
• To administer surveys, sweepstakes, promotions, or contests;
• To track fees and process billing and payment including sharing with third-party payment gateways and payment vendors in connection with the Platform;
• To improve and maintain the Platform and for product development;
• To address fraud or safety concerns, or to investigate complaints or suspected fraud or wrongdoing;
• To market and advertise our services and the Platform, including to send promotional emails regarding new products from QuackQuack, special offers from QuackQuack, or other information that may interest you;
• As permitted under applicable law, to contact you by text message regarding certain services or information you have requested;
• As permitted under applicable law, to contact you by telephone or text message regarding Platform features, improvements, or other products and services that may interest you;
• For QuackQuack's market research purposes, including, but not limited to, the customization of the Platform according to your interests;
• To contact you with information about your use of the Platform;
• For other research and analytical purposes; and
• To resolve disputes, to protect ourselves and other Users of the Platform, or third parties, including to protect property or safety; and to enforce any legal terms that govern your use of the Platform.

For Service Professionals, we may display information related to your business, including your name or your business’s name, publicly on your profile, except to the extent we tell you we will not display such information. If the information you provide us upon signing up for an account differs from the information you provide us as part of the verification data we collect, we have sole discretion in determining which information will be displayed publicly on your profile. We may combine information that we collect from you through the Platform with information that we obtain from affiliated and non-affiliated sources, and information derived from any other products or services we provide. We may aggregate and/or de-identify information we collect. We may use de-identified or aggregated information for any purpose, including without limitation for research and marketing purposes and may also disclose such information to any third parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.

We may, either directly or through third-party providers we engage to provide services to us, review, scan, or analyze your communications with other Users exchanged via the Platform or as otherwise described in this Policy for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research and User support purposes. For example, as part of our fraud prevention efforts, we may scan and analyze messages to prevent fraud or improper actions. We may also scan, review or analyze messages for research and product development purposes, as well as to debug, improve and expand product offerings. By using the Platform or engaging in off-Platform communications tracked by QuackQuack, you consent that QuackQuack, in its sole discretion, may, either directly or through third-parties we engage to provide services to us, review, scan, analyze, and store your communications, whether done manually or through automated means

WHEN DO WE DISCLOSE INFORMATION?

As part of our business, we disclose information as follows and for the outlined purposes, which include business purposes to provide and improve the Service and comply with legal and contractual obligations, as well as commercial purposes, such as to market our business.

• Affiliate Marketing Providers. If you submit a Request, we may share your personal information with Affiliate Marketing Providers so that they can contact you about your marketing options and possible opportunities.
• Affiliated Entities; Merger or Sale. We may share information with affiliated companies that are related to us under a common ownership where they comply with this Privacy Policy. Such disclosure is for our business purposes, including to provide and improve our offers. Further, we may share information as part of a sale, merger, acquisition, or other change in control or entity status, either in whole or in part. We reserve the right to transfer or assign your information as part of any such transaction or investigation.
• Service Providers and Contractors. We share information with our own service providers as needed to provide and improve the Service. Service providers only use your information for a contracted-business purpose. Such disclosure is for our business purposes, in particular to provide you with the Service. We, our providers, and third parties collect information in this way for advertising and marketing purposes. Certain third-party providers and certain cookies or similar technologies on the Platform enable us and third parties to serve you “tailored” advertising online that is more relevant to you and your interests.

DO WE COLLECT INFORMATION ABOUT CHILDREN?

No, we do not knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected such information, we will delete it from our database. We have no such information to use or to disclose to third parties or to otherwise report, including under the Children’s Online Privacy Protection Act (“COPPA”). We do not have actual knowledge of selling or sharing the personal information of consumers under the age of 16.

HOW DO WE PROTECT AND TRANSFER INFORMATION?

Consistent with others in our industry, we take efforts to employ technical, administrative, and physical security measures for personal information, taking into account reasonable security procedures and accessible technology. However, no system can be completely secure; and we cannot promise, and you should not expect, that your personal information will always remain secure. Your provision of personal information is at your own risk.
